1. SCOPE AND OBJECT OF THE GENERAL STATUS CONDITIONS
These General Terms and Conditions are intended, with the order form, and the other elements referred to in them, to regulate the terms and conditions governing the provision of the Shop Online Service by 4TECH, LDA, headquarters in the Shop, Avenida Amália Rodrigues, 153A, Bairro Beyond Vinhas, Tires, 2785 - 613, São Domingos de Rana, Parish of São Domingos de Rana, municipality of Cascais, district of Lisbon, under the unique number and identification company number 515265039, with the share capital of € 10,000, hereinafter referred to as 4Tech.
The Service consists of the provision, through the address of access to the Online Store, which, in addition to providing information on a set of services, allows the User to electronically acquire the services disclosed on the terms and conditions described herein. The acquisition of services must be done by Users who are 18 or older (eighteen) years old (individuals under the age of 18 years of age must be authorized by their representatives). The elements and information transmitted by the User will enjoy full legal effects, recognizing the User's electronic purchases, and can not claim the lack of signature for non-compliance with the obligations assumed.

3.PRODUCT INFORMATION AND CONTENTS
4Tech will endeavor to ensure that the information presented is free of typographical errors and will be promptly corrected whenever they occur. If you purchase a service that has different characteristics to those presented online, you have the right to proceed with the resolution of the purchase agreement in accordance with applicable legal terms (right of free resolution / refund - see point 8).
4Tech will make every effort to provide or provide all requested services, but it is possible that in certain cases and due to causes difficult to control by 4Tech, such as human errors or incidents in the computer systems, it is not possible to provide some of the requested services by the User. If any service is not available after you have purchased the service, you will be notified by email or by phone. At this point you will be presented with the possibility to change the marking, or request its refund, if you have already made the respective payment.
All information on price, products, specifications, promotional actions and services may be changed at any time by 4Tech.
4.1 All services sold in the Online Shop are in accordance with Portuguese Law. 4.2 The Store has adequate security levels, however, 4Tech shall not be liable for any damages suffered by the User and / or third parties due to delays, interruptions, errors and suspensions of communications that originate in factors beyond their control, in particular, any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or from downloading via the infected files service or containing viruses or other properties that may affect your equipment. If for any reason of error of access to the electronic site of the Online Shop there is no possibility of providing service, 4Tech will not be responsible for any damages. 4.3 Inquiries of data and information made within the scope of this Service are presumed to be made by the User, with 4Tech declining any responsibility arising from the misuse or fraudulent use of the information obtained. 4.4 4Tech shall not be liable for any loss or damage caused by abusive uses of the Service that are not directly attributable to it as an intent or gross negligence. 4.5 4Tech shall not be liable for any loss or damage resulting from failure to perform or faulty performance of the Service when it is not directly or indirectly attributable to it as a felony or gross negligence and is not responsible in particular for:
(i) errors, omissions or other inaccuracies regarding the information made available through the Service, ii) damages caused by the fault of the User or third parties, including infringements of intellectual property, (iii) non-compliance or defective performance resulting from compliance with judicial decisions or administrative authorities, or (iv) non-compliance or defective compliance resulting from the occurrence of force majeure situations, that is, situations of an extraordinary or unforeseeable nature, external to and not controlled by 4Tech, such as fire, power outages, explosions, wars, riots, civil uprisings, government decisions, strikes, earthquakes, floods or other natural disasters or other situations not controllable by 4Tech that prevent or impair the fulfillment of the obligations assumed. 4.6. 4Tech does not warrant that: i) the Service is provided uninterrupted, is safe, without errors or operates infinitely; ii) the quality of any service and / or information, fulfills any expectations of the User in relation to it; iii) any material obtained in any way through the use of the Service is used at the risk and risk of the User, who is solely responsible for any damage caused to his system and computer equipment or any loss of data resulting from such operation. iv) no advice or information, either oral or written, obtained by the User from or through the Service will create any guarantee that is not expressed in these General Conditions. 4.7. You agree that 4Tech can not in any way be held liable for any damages, including but not limited to damages for loss of profits, data, contents, or any other losses (even if you have been previously advised by the User about the possibility of occurrence of such damages), resulting: i) the use or impossibility of using the Service; ii) the difficulty of obtaining any substitute of goods / services; (iii) unauthorized access or modification to personal databases. 4.8 In the event of a reservation, failure to appear within 20 minutes after the scheduled time, 4Tech reserves the right to cancel its reservation, giving the service performed.
5. CONSUMER OBLIGATIONS
5.1. The user undertakes to: i) Provide personal information and electronic address; ii) Do not use false identities;
iii) Respect the period of validity of the requested service.
iv) Make the total payment up to 48 hours before the service is performed.
v) Sign a Term and Responsibility document, before performing the flight service.
5.2. If any of the data is incorrect or insufficient, and therefore there is a delay or impossibility in the processing of the purchase / reservation of the service, the responsibility is the User, and 4Tech declines any responsibility. In the event that the consumer breaches any of these obligations, 4Tech reserves the right to eliminate future purchases, block access to the store, cancel the provision of any other services provided simultaneously by 4Tech to the same User; Also, do not allow the future access of the User to any or any services provided by 4Tech.
6. PRIVACY AND PROTECTION OF PERSONAL DATA
The computerized processing of the data collected is done in compliance with Law 67/98 of 26 October, on the Protection of Personal Data, and they are intended for the processing of orders and communication with Clients, processing of requests for information and any complaints, statistical analysis, as well as their use for the purposes of direct marketing. 4Tech will not transmit to third parties personal data provided by Customer. The personal data identified in the form of the acquisition of the service, as being mandatory supply, are indispensable to the provision of the Service by 4Tech. The omission or inaccuracy of the data provided by the User is of its sole and entire responsibility and may give rise to the refusal to provide the Service by 4Tech. 6.3. The personal data of the User will be processed and stored in a computerized manner and are intended to be used by 4Tech within the contractual and / or commercial relationship with the User and, if authorized by the User, for the commercialization of A320 simulator services as well as products that are marketed by 4Tech. 6.4. In accordance with the applicable legislation, the User is guaranteed, without additional charges, the right of access, rectification and updating of his or her personal data, either directly or by written request, as well as the right to oppose the use thereof for the purposes set forth in previous number, and for this purpose, contact the entity responsible for the processing of personal data: 4Tech, LDA. 6.5. The Internet is an open network, so that the personal data of the User, other personal information and all content hosted on the Service may circulate in the network without security conditions, including the risk of being accessible and used by unauthorized third parties. the effect, and 4Tech can not be held liable for such access and / or use.
7. AMENDMENTS TO THE RESERVATION OR CANCELLATIONS
7.1 By user request The User may cancellation or change the date of reservation and/or intended service (for a service of equal or greater value), until 48h of the scheduled booked date, for a maximum of 6 months after his/her purchase date. Otherwise, as well as in the absence of attendance, the service will be considered use and without refund.

7.2 By decision of 4Tech 4Tech reserves the right not to process the flight reservation when it finds any inconsistency in the personal data presented or to observe misconduct on the part of the buyer. 4Tech reserves the right to change the scheduled time of your flight for reasons of force majeure (for example, availability of the employee or qualified pilot, technical problems in the simulator, impeding the experience, etc.). We'll get in touch with you to schedule a new time, or if you prefer, we'll refund you.
The request for reimbursement by the consumer will be analyzed case by case, when the service has not already been used, until 48 hours before the scheduled time and within 14 days of purchase. The consumer should make the request explaining the reasons that require the refund, sending e-mail to our e-mail address, email@example.com.
The refund request will always have an administrative cost of 15€, which will be charged to the amount previously paid.The amount due will be refunded to the consumer within 30 working days after the request for refund. Whenever possible the return must be made by the same payment method, but if it is not possible, the user must present proof of payment and account or card ownership, so that the return can be made by Bank Transfer.
9. INTELLECTUAL PROPERTY
9.1. The Store is a registered site and the service provided by the site itself is the responsibility of 4Tech. 9.2. The User acknowledges that the service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation. 9.3. You acknowledge that any content appearing in the advertising, prominence, promotion or mention of any sponsor or advertiser is protected by copyright and related rights laws, industrial property laws and other property protection laws, so any use of such content may only occur under the express authorization of the respective owners. 9.4. The User undertakes to respect in full the rights referred to in the preceding paragraph, namely to refrain from any acts that may violate the law or said rights, such as reproduction, marketing, transmission or placement to the public's disposal of such contents or any other unauthorized acts that have as their object the same contents.
10. SERVICE SECURITY CONDITIONS
10.1. The User undertakes to observe all applicable legal provisions, in particular, not to practice or encourage the practice of illegal acts or offensive of the good habits, such as the indiscriminate sending of unsolicited communications (spamming) in violation of the provisions in the legislation applicable to the processing of personal data and advertising communications by means of automatic calling devices, and shall also observe the rules of use of the Service, otherwise 4Tech will suspend or deactivate the Service in accordance with the provisions of point. 10.2. The User expressly acknowledges and accepts that the IP Network constitutes a public electronic communications network that can be used by several users, and as such, subject to computer overload, and therefore 4Tech does not guarantee the provision of the Service without interruption, loss of information or delays 10.3. 4Tech also does not guarantee the provision of the Service in situations of unpredictable overload of the systems in which it is supported or of force majeure (situations of an extraordinary or unforeseeable nature, external to 4Tech and that can not be controlled by it). 10.4. In the event of interruption of the provision of the Service due to unpredictable overload of the systems in which it is supported, 4Tech undertakes to regularize its operation as soon as possible.
11. SUSPENSION AND DISABLED SERVICE SHOP
11.1. Regardless of any prior or subsequent communication, 4Tech may, at any time and in its sole discretion, discontinue the provision of the Service and / or part of the Service to any or all Users. 11.2. 4Tech also reserves the right to suspend or immediately cease access to the Service, in the following cases: a) When the User does not observe the conditions of use referred to in point 5 and others referred to in the general conditions; b) When 4Tech ceases access to the Lodge, by giving prior notice 15 days prior to the date of termination. 11.3. In the situations described above, 4Tech will communicate to the User, in advance so that the user can safeguard the contents of his / her area of order viewing within 3 (three) business days from the sending of the e-mail or availability information on the Service homepage.
12. TECHNICAL SETTINGS
12.1. Sem prejuízo do disposto no número seguinte, a 4Tech poderá alterar o Serviço e/ou as condições técnicas de prestação do mesmo, bem como as respetivas regras de utilização, devendo divulgar ao Utilizador tais alterações com uma antecedência mínima de 15 (quinze) dias.

13.1. Without prejudice to other forms of communication set forth in these General Conditions, notifications made to the User that relate to the Service, including any changes to these General Conditions, may be made to the User's email address, by SMS or telephone contact . 13.2. The User agrees to receive any communication and / or notification related to the Online Store, to the address, telephone number and or e-mail address ("e-mail") indicated in the ordering process.
14.1. The User may submit any contractual conflicts, arbitration and mediation mechanisms that are or may be legally constituted, as well as claim from 4Tech acts and omissions that violate the legal provisions applicable to the acquisition of assets. 14.2. The complaint must be filed within a maximum of thirty (30) days, counted from the knowledge of the facts by the User, being registered in the information systems of 4Tech that should decide the complaint and notify the interested party within a maximum period of thirty (30) days from the date of receipt.
15. SAFETY RULES DURING A320 SIMULATOR SESSIONS
The use of the simulator involves a certain degree of physical mobility. Please contact us at the time of the appointment, if you have any questions or concerns. The use of any sharp, pointed or dangerous cutting object is prohibited. No smoking or fire. It is forbidden to chew gum. It is forbidden to take animals. Minimum age 18 years, when unaccompanied by an adult. It is forbidden to use the simulator under the influence of alcohol or any type of drug. We advise comfortable footwear with heel not exceeding 5 cm. We advise you to show up at least 15 minutes in advance to ensure that your flight starts on time. We advise you to consult the information specific to the type of flight you want and the price list, before scheduling. You can't test or try the simulator before using it.
Before the start of the simulator session, you will be asked to sign a Term of Responsability document.
The simulator can only be used without accompaniment by those who are duly authorized by 4Tech. The abusive use of the simulator equipment will lead to the immediate interruption of the session, without the right to any kind of refund. Responsible use of the equipment is mandatory. All damages will be the sole responsibility of the users that cause them, as well as the costs related to the repair of the equipment. It is forbidden to carry any kind of food or drink into the simulator. Any interruption in the simulator session by the customer may be compensated if 4Tech so desires and if it does not prejudice the following markings.
During the TAP AIR PORTUGAL "Pilot for a day" experience, is not allowed to bring photo cameras, camcorders or mobile phones, inside the cockpit.
Prices are to be understood in euros, and include VAT at the rate in force. We reserve the right to modify at any time, without prior notice, the prices of the services provided.
17. PAYMENT METHODS
Mandatory payment before start of service. We accept payments through Visa, Mastercard, or bank transfer (send us the proof of payment, name and the name of the service), up to 48h before the scheduled service.
18. APPLICABLE LAW
The Agreement is governed by Portuguese law.
